This Data Usage & Licensing Policy ("Policy") governs the usage and licensing of datasets purchased from FutureBeeAI ("we," "our," or "us"). By purchasing or using any dataset from FutureBeeAI, you ("Buyer" or "Licensee") agree to comply with this Policy.
This Policy provides standard licensing terms; however, any specific agreement signed between the Buyer and FutureBeeAI shall supersede these clauses in case of any conflicts.
1. Scope of this Policy
This Policy applies to all datasets purchased or accessed from FutureBeeAI, including but not limited to:
Audio datasets (speech, sound events, conversational data, etc.).
Text datasets (transcriptions, annotated text, chat logs, etc.).
Image datasets (object recognition, scene datasets, labeled images, etc.).
Video datasets (human activities, scene analysis, surveillance, etc.).
Custom-collected datasets (specially collected as per Buyer’s request).
Processed datasets (annotations, transcriptions, and other enhancements).
This Policy does not cover dataset samples, metadata, attribute details, or descriptions, which are governed by the Terms of Use and may only be used for evaluation before purchasing.
2. License Grant
FutureBeeAI grants the Buyer a non-exclusive, non-transferable, non-sublicensable license to use the purchased dataset solely for the approved use cases outlined in this Policy.
The license does not transfer ownership of the dataset to the Buyer. FutureBeeAI retains all intellectual property rights over the dataset unless explicitly stated otherwise in a signed agreement.
2.1 Types of Licenses
FutureBeeAI offers the following types of licenses:
A. Standard License (Non-Exclusive)
The dataset may be used for internal research, AI/ML training, and product development.
FutureBeeAI may sell the same dataset to other buyers.
Redistribution or reselling is strictly prohibited.
B. Exclusive License (Upon Agreement)
The dataset is sold exclusively to the Buyer, and no other party will have access to the same dataset.
Subject to a separate agreement, pricing, and licensing terms.
C. Custom Dataset License
If a dataset is specifically collected or processed for a Buyer, usage rights will be defined in the contract.
Can be exclusive or non-exclusive depending on the agreement.
3. Permitted Uses
Buyers may use the purchased dataset for:
AI/ML Model Training & Testing: Training, validating, and testing AI models in compliance with applicable laws.
Academic & Scientific Research: Conducting research that does not involve public redistribution of the dataset.
Product Development: Incorporating insights from the dataset into proprietary software, models, or applications.
Internal Business Use: Using datasets for internal analytics, market research, or innovation.
Data Processing & Enrichment: Using the dataset for internal annotation, processing, or other value additions.
4. Prohibited Uses
Buyers must not:
Resell, Distribute, or Share: Datasets cannot be resold, shared, sublicensed, or publicly distributed, including open-source platforms.
Use for Biased, Unethical, or Harmful AI Applications: No use in discriminatory AI models, illegal surveillance, or unethical applications.
Modify for Redistribution: Buyers cannot alter the dataset and resell it as a derivative dataset.
Use in Violation of Laws: No use that violates GDPR, CCPA, or other applicable data protection laws.
Claim Ownership: Buyers cannot claim FutureBeeAI’s dataset as their own intellectual property.
If a Buyer wishes to use the dataset for any purpose outside of the permitted uses, they must obtain explicit written approval from FutureBeeAI.
5. Data Security & Compliance
Buyers must implement reasonable security measures to prevent unauthorized access, copying, or redistribution of the dataset.
Data Access Restrictions: Access to the dataset should be limited to authorized personnel within the Buyer’s organization.
Compliance with Data Protection Laws: The Buyer is responsible for ensuring their use of the dataset complies with GDPR, CCPA, or any other applicable regulations.
Reporting Unauthorized Use: If unauthorized access or misuse occurs, the Buyer must notify FutureBeeAI immediately.
6. Ownership & Intellectual Property
All datasets remain the sole property of FutureBeeAI unless an exclusive license is granted in writing.
Buyers do not acquire any ownership rights, copyrights, trademarks, or proprietary rights related to the dataset.
Any insights, models, or products derived from the dataset belong to the Buyer, provided they do not expose, distribute, or share the original dataset.
7. Refund & Cancellation Policy
No Refunds After Download: Due to the nature of digital datasets, refunds are not provided once a dataset has been accessed or downloaded.
Refunds Before Download: If a Buyer cancels before accessing the dataset, FutureBeeAI may offer a refund at its discretion.
Data Quality Disputes: If a dataset does not meet agreed-upon specifications, Buyers may request a resolution, but refunds are not guaranteed.
8. Violation & Termination
If a Buyer violates this Policy:
FutureBeeAI may terminate the license immediately.
FutureBeeAI reserves the right to pursue legal action for damages.
The Buyer must delete all copies of the dataset upon termination of the license.
FutureBeeAI may also blacklist Buyers who engage in unauthorized use of datasets.
9. Overriding Agreement Clause
While this Policy serves as a standard guideline, it may be overridden by a separate agreement between the Buyer and FutureBeeAI. In case of any discrepancies, the terms outlined in the final signed agreement will take precedence over this Policy.
10. Changes to This Policy
FutureBeeAI may update this Policy at any time. Material changes will be communicated via email or website updates. Continued use of the dataset after updates constitutes acceptance of the revised terms.
11. Governing Law & Dispute Resolution
This Policy is governed by the laws of India, and disputes will be resolved through arbitration in Ahmedabad, Gujarat unless otherwise agreed upon.
